1. Acceptance of Terms and Institutional Scope
This Terms of Use agreement ("Agreement") constitutes a legally binding contractual covenant between your enterprise entity, its authorized officers, and representatives (collectively referred to as "the User", "you", or "your") and AUSSAFINA TRADING PTY LTD (ABN 94 694 431 840, ACN 694 431 840), hereafter referred to as "AusSafina," "we," "us," or "our."
By accessing, browsing, interacting with our contract procurement fields, or utilizing the project evaluation frameworks across our corporate portal, you formally acknowledge that you have read, understood, and agree to be bound by these Terms of Use.
Enterprise Access Constraint: This portal is engineered and maintained exclusively as a business-to-business (B2B) corporate environment. Access is restricted to commercial corporations, joint ventures, certified supply entities, and public sector procurement authorities. This supply chain network is not intended for consumer, retail, or private personal use.
2. Proprietary Estimation Logic and Ledger Disclaimer
AusSafina provides an interactive project estimation tool, specifically designated as the Live Project Ledger Demonstrator.

Diagnostic Classification: The demonstrator environment is categorized strictly as a diagnostic, project estimation asset designed for preliminary planning and educational evaluation of statutory framework benchmarks.

Non-Binding Outputs: The calculated estimations, ledger outputs, and performance visualizations—including the generated Risk Insulation records and framework allocation targets—do not constitute binding financial, statutory, legal, or formal procurement audit determinations.

Independent Verification: While our compliance criteria are synchronized against active regulatory thresholds (such as the Fair Jobs Code, Indigenous Procurement Policy Mandatory Minimum Requirements, and the Local Jobs First Act), you acknowledge that final contract eligibility and procurement panel compliance remain subject to direct validation by an authorized AusSafina compliance specialist.
3. Intellectual Property and Corporate Assets
All structural, operational, and functional elements comprising this corporate portal are the exclusive proprietary property of AusSafina or its third-party licensing partners. This protection encompasses, without limitation:

The visual interfaces, technical graphics, design layouts, and aesthetic profiles.

The underlying code bases, master stylesheet structures, and corporate portal files.

The proprietary calculation engines and regulatory parameters that process data inputs into compliance milestone markers.
Except where explicitly authorized by prior written consent, the user is strictly prohibited from copying, distributing, republishing, framing, or scraping any asset belonging to our corporate domain.
4. User Credentials and Secure Portal Restrictions
In alignment with our corporate portal infrastructure containing the secure portal login panel, the following conditions govern your interaction:

5. Prohibited Activities and System Integrity
Users are strictly forbidden from engaging in behaviors that threaten the structural integrity, stability, or operational accuracy of the AusSafina supply chain network. Prohibited actions include:

Decompiling, reverse-engineering, or attempting to extract the underlying data structures or calculation metrics governing our project estimation tool.

Deploying automated web crawlers, data scraping tools, or harvesting bots within our statutory manifest databases or portal fields.

Utilizing data payloads or text strings inside our inputs containing malicious scripts, SQL injections, or server-straining automation loops.
6. Limitation of Liability
To the maximum extent permitted under Australian law, including the Australian Consumer Law, AusSafina shall not be held liable for any direct, indirect, incidental, consequential, special, or exemplary damages, financial shortfalls, or project delivery variances arising out of or in connection with:

Your operational reliance on the provisional percentages or estimated risk scores displayed inside our tracking modules.

Temporary system maintenance, technical downtime, or localized interface rendering variances.

Decisions, contract bids, or joint-venture procurement pricing schedules executed based on information compiled within our documentation frames.
7. Statutory Variations and Continuous Updates
Australian public infrastructure regulations, state-based procurement targets, and social value thresholds are inherently subject to dynamic legislative adjustment.
AusSafina reserves the right to modify, adjust, or redraw the regulatory calculation rules within our portal without prior notice, ensuring continuous calibration with current governmental directives (including updates to Victorian DJSIR frameworks, the Building Equality Policy, or Federal Indigenous Procurement rules). Your ongoing interaction with our portal workspace establishes your permanent acceptance of these automated updates.
8. Severability
If any provision or clause of these Terms of Use is discovered to be invalid, illegal, or unenforceable under a directive issued by a Victorian court or applicable Commonwealth authority, that specific provision shall be limited or severed to the minimum extent necessary. The remainder of these Terms of Use shall continue in full force, remaining completely operational and legally binding.
9. Governing Law and Dispute Resolution
This Agreement, its structural implementation, and any legal conflicts arising from your interaction with our platforms are governed exclusively by the laws of the State of Victoria, Australia.
Both parties formally submit to the jurisdiction of the courts of Victoria and the Federal Court of Australia sitting in Melbourne to resolve any operational, legal, or contract-allocation disputes.
